When is England going to introduce a system of signed pre-contracts which include a buyer deposit. Globally a buyer is expected to put down a deposit and lose their deposit if they do not proceed . When home buyer and the vendor agree the purchase price, the pre-agreement is signed and a deposit paid to be held in solicitor’s account until final completion. A date is set in the pre-agreement for the final contract exchange. If the buyer does not go through with the purchase he loses his deposit unless he or his solicitor can find some legal concerns in title of property. Everyone knows what is expected of them and there is no gazumping. Easy, but for some reason it is not introduced in England.
If such a conveyancing process were introduced in England then property information available to the purchaser needs to be a lot more reliable than it currently is. In the USA, for instance, a real estate agent can be sued if they provides the buyer with incorrect information. How many estate agents in England are prepared to take on that kind of risk?
When we bought a house a few years ago the estate agent told us he was “97% confident” that all the kitchen appliances were included in the purchase. As it happened they weren’t, and if he considered he’d be sued for getting it wrong, he might have bothered to ask the seller before answering our question. If EAs here are ready to stop talking up properties and glossing over their flaws, then a system of signed pre-contracts might be appropriate.
As the system currently stands, one of the few things that tips the balance of power in the buyer’s favour is that they can reduce their offer or pull out of a purchase if the survey reveals flaws they weren’t previously informed about.
